Sobreasy terms and conditions

This is a translation of the Dutch terms and conditions. In case of any difference, the Dutch version prevails.
1. Definitions and applicability
- Sobreasy, we, us: Sobreasy, a sole proprietorship registered with the Dutch Chamber of Commerce (KvK) under number 93376219.
- The app: the Sobreasy mobile application (iOS) and the website sobreasy.nl.
- Circle: the group of the user and their supporters.
- User: the person in recovery who manages the recovery profile.
- Supporter: a member of the circle around the user.
- Payer: the member of the circle who took out the subscription for the circle.
- You: whoever uses the app, regardless of their role.
These terms apply to all use of the app, including the website. By creating an account, you agree to these terms and to our privacy statement.
2. What Sobreasy is
Sobreasy is an app that connects a person recovering from alcohol addiction with their own support circle. Among other things, the app offers tests with video, a button to let the circle know a moment is hard, a group chat and a timeline with information about the recovery process. For a test you need your own breathalyser; it is not included with the app.
Sobreasy is not a medical device and not a replacement for professional care. The information in the app, including the timeline, is for information only. Sobreasy does not make diagnoses, does not give treatment advice and is not suitable for emergencies. If in doubt, always consult a GP or addiction care service. In a medical emergency: call 112 immediately.
3. Creating an account and use
- You create an account with a valid email address. You are responsible for keeping your password secret.
- When registering, you confirm that you are 18 or older.
- You can join a circle as a user (the person in recovery) or as a supporter (invited by the user, or by the supporter who started the circle).
- You provide correct and up-to-date information. Sobreasy may suspend or terminate an account in case of misuse, fraud or breach of these terms.
4. Subscription, price and trial period

As soon as one member of the circle pays, the whole circle has access. Prices include 21% Dutch VAT.
5. Right of withdrawal
As a consumer, you normally have a 14-day cooling-off period (right of withdrawal) for a service you sign up for at a distance. Because the Sobreasy trial period is free and you only pay after 30 days, you can always cancel free of charge during that period. In practice you therefore have more time to reconsider than the legal 14 days.
To let you use the service immediately from the moment you sign up, we ask you to explicitly confirm when starting the trial period that you agree to this, and that you understand you waive the formal right of withdrawal once you use the app within the trial period. If you cancel within 30 days, no money is ever charged.
6. Payment and invoicing
Payments are handled by Stripe. Sobreasy does not store payment details such as card numbers itself. If a payment fails, the circle's access may be temporarily suspended until the payment has been made. You can find invoices via "Manage subscription" in the app's settings, in Stripe's customer portal.
7. Cancelling, leaving and deleting your account
Cancelling. The payer can cancel the subscription at any time via "Manage subscription" in the app's settings. Cancelling stops the next payment; there is no refund for the current period. The circle keeps access until the end of the paid period.
Deleting an account is permanent and cannot be undone. Whoever deletes their account does not get a choice about the subscription. What happens depends on your role and on who the payer is.
- The payer deletes their account: the subscription continues until the end of the paid period and then stops. The other members are notified, and another member can take over the subscription starting on that date, so nobody pays twice. This also applies if the payer is the person in recovery; their data and the entire group chat of the circle are then deleted as described for the user. If a payment is outstanding at that moment, the subscription stops immediately.
- The user (the person in recovery) deletes their account and is not the payer: the circle continues to exist for the supporters. The user's data and the entire group chat of the circle are deleted. The subscription continues until the end of the paid period and then stops, unless a person in recovery joins the circle again before that date. The payer is notified.
- A supporter deletes their account and is not the payer: the circle and the subscription remain unchanged. The supporter's text messages in the group chat remain visible to the other members, without a name and no longer linked to an account. Photos the supporter shared in the group chat are deleted.
- The last member of the circle deletes their account: the circle ends and the subscription stops immediately. There is no refund for the current period.
If the subscription ends without anyone taking it over, the circle keeps access for another 7 days. After that, the app can no longer be used by the circle until a member takes out a subscription. No data is deleted in that case.
Transaction data is kept for 7 years after deletion because of the tax record-keeping obligation in the Netherlands.
8. What you don't do
You don't use Sobreasy to:
- threaten, intimidate or harass anyone else
- post content that is hateful, discriminatory or unlawful
- use the app for anything other than its purpose: support in recovery within your own circle
- try to gain access to a circle you have not been invited to, or bypass security
In case of a breach, Sobreasy may remove content and suspend or terminate an account.
9. Liability
Sobreasy does its best to keep the app working reliably, but does not guarantee uninterrupted or error-free operation. Sobreasy is not liable for damage resulting from the use of the app, unless it is caused by intent or gross negligence on our part. This expressly also applies to decisions you make based on the information in the timeline (see Article 2): it does not replace medical advice.
This limitation of liability does not affect what mandatory consumer law prescribes.
10. Changes
We may update these terms. If there is a significant change, we will let you know in advance via the app or by email. If you continue to use the app after the change, you agree to the new terms.
11. Applicable law and disputes
These terms are governed by Dutch law. In case of a dispute, we will first look for a solution together. If we can't reach one, the competent court in the Netherlands has jurisdiction. This does not affect any mandatory consumer protection you have under the law of your country of residence.
